The plaintiff in error, Phillip Hawthorne (hereinafter "defendant"), was convicted on December 5, 1967, of a violation of
sec. 161.275 (1), Stats. (sale of marijuana). Defendant was sentenced to the Wisconsin state prison for an indeterminate term
of not more than five years. This charge arose out of an investigation into drug traffic which was being conducted by the Milwaukee vice squad. On March
21, 1966, Earl Marshall, a member of the vice squad, entered Broady's Club 26 in Milwaukee, Wisconsin, hoping to meet a man
named "Slim." Marshall had previously been informed that "Slim" could obtain marijuana and that "Slim" could be contacted
at the Club 26.
